Sharon has a similar rule she pointed out to me.
Any company electing to have new office built rather than just moving into new offices is facing a market failure or collapse within the next 3 years. Her emperical evidence to this is in joining companies that have gone bust or downsized just after moving into new offices.
A defensive patent is better than prior art because it often lets you counter-sue. One patent is not much help, but a big portfolio often means you can.
It is also a bargaining chip in cross-licensing deals. There is some discussion of both these on my site.
